These Terms apply only to your access to and use of the Site. They do not change the terms of any other agreement you may have with the Committee, including any donation or merchandise transaction terms presented to you at checkout.

  1. CHANGES TO THESE TERMS

We may change these Terms at any time, in our sole discretion. Changes are effective immediately when posted on the Site. By continuing to use the Site after changes are posted, you accept the updated Terms. If you do not agree to the updated Terms, stop using the Site.

  1. PRIVACY

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and disclose information. Please review the Privacy Policy posted on the Site.

  1. COPYRIGHT AND LIMITED LICENSE

Unless otherwise noted, the Site and all content and materials on the Site, including text, graphics, photographs, video, audio, designs, software, code, data, and the selection and arrangement of those materials (collectively, the “Site Materials”) are owned by the Committee or used with permission and are protected by U.S. and international intellectual property laws.

We grant you a limited, revocable, non-transferable, non-sublicensable license to access and use the Site and Site Materials for your personal, informational, and non-commercial use. This license does not allow you to do any of the following without our prior written consent: resell or commercially use the Site or Site Materials; reproduce, distribute, publicly perform, or publicly display Site Materials except as expressly permitted; modify or create derivative works; use data mining, robots, scraping, or similar data gathering or extraction methods; download any portion of the Site other than normal page caching; or use the Site or Site Materials for any purpose not intended by us.

Any unauthorized use terminates the license granted by these Terms and may violate applicable laws.

The Committee name, logos, slogans, and the look and feel of the Site may be trademarks, service marks, or trade dress of the Committee. You may not use them without prior written permission. All other trademarks appearing on the Site are the property of their respective owners. References to third-party products, services, or organizations do not imply endorsement by the Committee.

The Site may include interactive features such as comment sections, forms, message tools, or other areas where you can post or submit content (“Interactive Areas”). If you use Interactive Areas, you are responsible for your content and your conduct.

You agree not to post, upload, submit, transmit, or otherwise make available any content that is unlawful, defamatory, harassing, threatening, obscene, pornographic, deceptive, fraudulent, or otherwise objectionable; infringes intellectual property or other rights; impersonates any person or entity or misrepresents affiliation; contains unsolicited promotions or solicitations; includes private or sensitive personal information of others; contains viruses, malware, or harmful code; or violates these Terms or any posted guidelines.

We may remove, screen, or edit user content at any time, for any reason, without notice. We are not responsible for user content posted by you or others.

To the extent you post user content to the Site, you grant the Committee and its designees a nonexclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, translate, create derivative works from, distribute, perform, and display that content in any media, including for communications, advocacy, and fundraising, without compensation or attribution, except where prohibited by law. You represent that you have the rights necessary to grant this license.

  1. REGISTRATION DATA AND SECURITY

If the Site allows registration or account creation, you agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of any login credentials and for activity under your account.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Committee and its officers, directors, employees, contractors, volunteers, agents, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Site, your violation of these Terms, or your infringement of any rights of another.

THE SITE AND SITE MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ARE RESPONSIBLE FOR USING APPROPRIATE SAFEGUARDS TO PROTECT YOUR DEVICES AND DATA.

  1. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMMITTEE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100), OR THE AMOUNT YOU PAID TO THE COMMITTEE THROUGH THE SITE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

  1. GOVERNING LAW AND VENUE

These Terms and your use of the Site are governed by the laws of the District of Columbia, without regard to conflict of laws rules, except where federal law applies.

You agree that any action arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the District of Columbia, and you consent to personal jurisdiction and venue there.

If you prefer Alaska as governing law and venue instead of DC for this committee’s posture, swap the jurisdiction and venue accordingly. Do not half-swap it. That’s how you get messy.

  1. TERMINATION

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. All provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

  1. SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

  1. DONATION TERMS AND POLICIES

If you make a donation through the Site, you agree to any additional terms presented during the donation process. Federal law requires donors to affirm that the following statements are true and accurate:

Your contribution is made from your own funds and not from the funds of another. You are making this contribution with a personal credit card or personal bank account and not with a corporate or business credit card or business account. You are not a federal government contractor. You are a U.S. citizen or lawfully admitted permanent resident. You are at least 18 years old. Contributions are not deductible for federal income tax purposes. Contributions are subject to applicable federal contribution limits and prohibitions.

Refunds and cancellations: Donations are typically final. If you believe an error occurred with your online donation, contact us at info@danforak.com and we will review the issue.

Receipts and confirmations: Donation confirmations are generally sent by email. You are responsible for providing accurate contact information.

Merchandise or fulfillment (if applicable): If the Site offers merchandise or other items in connection with donations, any fulfillment, shipping, or handling terms will be disclosed at checkout and will apply to that transaction.

If you provide your mobile phone number, you consent to receive calls and text messages from the Committee, including autodialed and automated messages, at the number you provide. Consent is not a condition of purchase or donation. Message frequency may vary. Message and data rates may apply. Reply STOP to cancel. Reply HELP for help.
